Pine Strawberry School District #12 does not discriminate on the basis of race, color, religion, national origin, ethnicity, sexual orientation, sex (including pregnancy), gender identity, gender expression, genetic information, age (over 40), or disability in admission to its programs, services, or activities, in access to them, in treatment of individuals, or in any aspect of their operations. The lack of English language skills shall not be a barrier to admission or participation in the District’s activities and programs. Title IX Sex Discrimination Information
Sex discrimination (under Title IX) is conduct on the basis of sex that is one or more of the following:
- The provision of aid, benefit, or services of a school on an individual's participation in unwelcome sexual conduct;
- Unwelcome sex-based conduct that, based on the totality of the circumstances, is subjectively and objectively offensive and is so severe or pervasive that it limits or denies a person's ability to participate in or benefit from the school's education programs or activities.
- Sexual assault, dating violence, domestic violence, or stalking.
Title IX
The U.S. Department of Education’s Office for Civil Rights (OCR) enforces, among other statutes, Title IX of the Education Amendments of 1972. Title IX protects people from discrimination based on sex in education programs or activities that receive Federal financial assistance. Title IX states that:
No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.

The district shall designate and authorize an employee as the Title IX Coordinator to comply with its responsibilities pertaining to sexual harassment under Title IX. Inquiries about the application of Title IX should be directed to the Title IX Coordinator listed below:

Reporting Sex Discrimination
Any person may report sex discrimination regardless of whether the person reporting is the person alleged to be the victim of the reported conduct or not.
- Reports may be made in person, by submitting the form, by phone, or by email using the contact information provided by the Title IX Coordinator.
- Reports can be made at any time, including non-business hours, by using a telephone number or email.
- The district will respond promptly when any school employee has been given notice of sex discrimination.
- Upon receipt of a report of sex discrimination, the Title IX Coordinator or Deputy Title IX Coordinator will contact the alleged victim to inform them of the following:
- Their right to file a formal complaint.
- How to file a formal complaint.
- Supportive measures that may be available with or without filing a formal complaint.
Title IX Reporting
The formal complaint is the official document alleging sex discrimination, which can be filed by the student, employee, parent, or Title IX Coordinator. Once a formal complaint is filed and received by the Title IX Coordinator, the district’s grievance procedure is followed to provide a prompt and equitable resolution of complaints from students and employees alleging sex discrimination. The grievance procedure requires the following steps be taken:
- Both the complainant (alleged victim) and the respondent (alleged abuser) will receive a written notice of the complaint with sufficient details to allow a respondent to prepare a response.
- The respondent is presumed innocent.
- An investigation will be initiated after the written notice has been sent to both the complainant and the respondent. A written investigative report will be prepared and available for both parties to review. Both parties will have 10 days to respond to the evidence in writing.
- Evidence from the investigation will be objectively evaluated to reach conclusions about whether or not the respondent is responsible for the alleged sex discrimination. The standard of proof used is the preponderance of evidence.
- A written determination will be prepared and provided to both parties, along with information on how to appeal.
Retaliation
Neither the district nor any person may intimidate, threaten, coerce, or discriminate against any individual to interfere with any right or privilege secured by Title IX, or because the individual has in good faith made a report or complaint, testified, assisted, or participated or refused to participate in any manner in an investigation.
Student Rights & Supports
Pine Strawberry School District believes it is the right of every student to be educated in a positive, safe, caring, and respectful learning environment. A school environment inclusive of these traits maximizes student achievement, fosters student personal growth, and helps students build a sense of community that promotes positive participation as members of society.
Pine Strawberry School District, in partnership with parents, guardians, and students, shall establish and maintain school environments based on these beliefs. Pine Strawberry School shall implement age-appropriate programs designed to instill in students the values of positive interpersonal relationships, mutual respect, and appropriate conflict resolution.
The following basic guidelines of rights and responsibilities shall not be construed to be all-inclusive. Each student is obligated to respect the rights of classmates, teachers, and other school personnel. Students shall exercise their rights responsibly, with due regard for the equal rights of others and in compliance with the rules and regulations established for the orderly conduct of the educational mission of the District. Students who violate the rights of others or who violate rules and regulations of the District or of their school are subject to appropriate disciplinary measures.
Rights
- Students have the right to a meaningful education.
- Students have the right to physical safety.
- Students have the right to consultation with teachers, social workers, administrators, and anyone else connected with the school if they so desire, without fear of reprisal.
- Students shall not be subjected to unreasonable or excessive punishment.
- Students have the right to be involved in school activities provided they meet the reasonable qualifications of sponsoring organizations and school requirements.
- Students may present a complaint or grievance regarding a violation of their constitutional rights, equal access to programs, discrimination, or personal safety.
Protections
Positive Behavioral Intervention Supports and practices will be implemented to maintain a safe and positive school culture within the District. All students will be provided with the school procedures for the accountability of all students (District and school rules are published in the Parent/Student Handbook). Parents and students will notify building school administrator of any additional safety concerns as they arise to ensure safety of all.

Definition of Teacher Under ARS § 15977 I01014 (R01020)
The Pine Strawberry School District #12 has officially approved the definition of "teacher" in response to meeting the Arizona State Legislature’s request. On June 20, 2018 the Pine Strawberry Governing Board approved the definition of “teacher” using the Classroom Site Fund – A.G. Opinion I01-014.
Classroom Site Fund Definition A.G. Opinion I01-014 –concludes that the term “teacher” is not limited to traditional classroom teachers. “School districts and charter schools may use such funds for compensation increases for certified or certificated teachers and others employed to provide instruction to students related to the school's educational mission.” An employee who receives base compensation from Prop. 301 monies would also be eligible to receive a salary increase as a teacher. It should be noted, however, that subsequent court rulings and attorney general opinions have narrowed this definition to those possessing a teaching certificate and who spend at least 50% of their time devoted to instruction central to the school’s educational mission.
